I was robbed by an Indian seller, with support of Paypal and eBay.

On 04/05/11 I bought a Micromax A60 3G WI-FI ANDROID 2.1 mobile phone on eBay.


The seller is an Indian guy, named RANDEEP SIGH ARORA.


Randeep´s site on web is http://www.digitacindia.com/ (DIGITAC COMPUTERS INDIA)

Therefore, my mobile phone was delivered to another people. And Pay Pal didn´t do nothing.

I was robbed! Paypal and eBay didn´t nothing!

I will tell this history here. Please, pay attention in order to avoid this kind of problem to you. The posts are in chronological order bellow.

I ordered DHL to sent the item back ... then, I was robbed!

  • Now, I show the dispute opened on Paypal. Please, see that the seller changed idea! The asked me to sent the item back, but he argued the dispute just after he promised to get refund.
During the Paypal´s analysis of the dispute, the seller ordered DHL to delivery the item to someone else!!! I guy named Rodrigo received the item on April 18th (DHL told it on his site).

Paypal don´t give me the reason. Paypal didn´t do nothing! Despite of the seller´s promise of full refund! 

I was just robbed by Randeep, with help of Paypal! So, now, I appealed the closed case on Paypal.

The ordinary mail service doesn´t charge import tax, added value tax and administrative services tax, as DHL did (total: US$ 158).The seller agreed with me, and he promised I would get full refund.In order to do this, I would tell DHL to sent the item back to the seller.On april 13, 3:27, using an eBay message (#260758469339), the seller told me: "Dear Bruno,I am not in a position to pay DHL. Please return the shipment. You will get your refund. warm regardsRandeep Singh Arora"After the message above, I told DHL to return the item immediatelly.I considered the dispute solved and I told DHL to send the item back to seller, in order to get my refund. Now, I am waiting to get my full refund. I hope the seller carry out his promise.
  • 14-04-2011 06:26 PDT - Seller: The courier charges have already been paid 100% in advance by seller. DHL always takes payment in advance for International shipment. There is no post payment procedure in them. The charges which buyer is asked for, are the local taxes in his country which he has to pay. If he does not pay, the item will be destroyed by the Local authorities there itself as per the rules on ( Non paymeny of taxes/No claim ). We have been informed by the DHL on this. It can be verified. Buyer is asking me to pay the local taxes of his country which is not possible at all for me and i never gave this commitment. I committed the courier charges and the item and i did that. I also used the best courier company DHL. The shipment number was given to him immediately. The item cannot come back unless the tax authorities are given the payment by him.
  • 11-04-2011 12:39 PDT - Buyer: I paid US$ 169 for a mobile phone plus US$ 70 for shipping, the total is US$ 239. Therefore, the seller sent the item using courier service, the shipping are being charged again. It wasn´t informed by the seller. I´m retracting the purchase. The item was sent back to the seller because it was not received by the buyer.

Dear randeep_singh_arora,

The ebay´s item # 260758469339 arrived at the destination, but the conditions aren´t as specified in the seller´s site. I paid US$ 169.00 for the item (a mobile phone) sold plus US$ 70.00 for shipping. Here, more expenses were charged on me, because of the mode of delivery (Courier Service). I´m being charged of import taxes (mobile phones aren´t taxed, except if imported via courier services), valued added tax (a local tax, because of courier service too) and a delivery tax (by DHL). The total is US$ 156,78. Notice that I already paid US$ 70 for delivery, but the DHL is charging me by US$ 27.09 because of it. I don´t want the item anymore, and I will require refunding for Paypal.

Dear billathome,

I understand your concern truly that some unexpected charges have been charged upon you. You would appreciate that we dispatched your item through DHL which is by far the best in international shipping. Unfortunately some taxes have been charged which has made you disappointed. You would well understand that rule of taxes are different in different countries and we cannot keep track of it. Having a lesson from this transaction, i will never dispatch any item to Brazil from now onwards as it would only disappoint both the buyer and seller at the end.
May i know what is the status now ? Have you returned the shipment or you have received the same ? Please let me know so that we bring a solution to the same.

I don´t tell the order to dispatch the item back to home, yet. I sent a message telling you first. The central problem is that you don´t tell in your site that you use Courier Service. Under ordinary mail service, mobile phones don´t pay import tax or value added tax (this one is for the courier service from São Paulo to Brasília), 60% and 12% of to the item´s price (US$ 169). Moreover, DHL is charging me again for the delivery service itself (R$ 43,61)! I have already imported through eBay, but it was always through mail service, with no extra charges. In this case, the additional charges are R$ 255,15 (US$ 158,50). This is almost the item´s price. It´s cheaper to buy an android sell phone here. In case of I have to pay for these taxes, I prefer to send it back.

I appreciate your concern. We always ship through DHL. Speedpost India ( The general post ) is not taking parcels for Brazil. Moreover it can always be tracked through DHL and is easy for everyone. I got a lesson this time. 
I know paying so much will not be possible from your side. You please return the item in that case. We will get your full amount refunded.

I just finished my conversation with DHL. They are surprised why DHL asked for any charges when they reached you as the shipping charges were already paid by me. My friend, taxes
are rules of your country and DHL will not interfere on that. No one other than you can challenge or request them to ignore them. 
It looks like, if you do not receive the parcel, i will have to bear all the charges along with the return delivery charges of DHL. 
If you can do something and receive the parcel, that would be the best and If you are sure nothing can be done by your side, please go ahead and return the parcel.

I bougth this mobile phone. In Brazil, mobile phones sent by mail service don´t pay any kind of tax. In India, the mail service is offered by Speedpost India.

Therefore, the seller didn´t told me the item purchased would be sent by courrier service. There is nothing in the item´s page about it.

In Brazil, the courier service itself is charged by two taxes: import tax (60%) and add value tax (12%).

The problem is worst. The courrier service company, named DHL, charged me R$ 43,00 by "administrative services". I was charged again by the delivery service!!!! Twice!!! The seller already paid US$ 70,00 for DHL. But DHL is charging me two government taxes and this administrative tax!!!
